Terms of Service (EULA)

1. Agreement to Terms

By accessing or using GymTok, you agree to be bound by these Terms of Service (including this EULA) and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Subscriptions, billing, and auto-renewal

GymTok may offer optional paid subscriptions that unlock premium features (for example, advanced AI coaching tools and related functionality). Free features may continue to be offered separately; subscription benefits, pricing, and availability are described in the app and may change from time to time.

Payment processing. Subscriptions purchased through our mobile apps are processed by the platform provider—Apple (App Store) or Google (Google Play)—not directly by GymTok, LLC. You authorize the applicable platform to charge your payment method on file according to its terms. We do not receive or store your full payment card number.

Auto-renewal. Paid subscriptions renew automatically at the end of each billing period (for example, monthly or annual) unless you cancel before the renewal date. The renewal price is the then-current price for your plan, which we or the platform may display before you confirm a purchase or renewal.

Cancellation. You may cancel auto-renewal at any time through your Apple ID or Google account subscription settings (or equivalent controls on your device). Cancellation takes effect at the end of the current paid period; you will generally retain access to premium features until that period ends unless stated otherwise by the platform.

Refunds and billing disputes. Refund eligibility, family sharing, and billing disputes for purchases made through Apple or Google are governed by those companies' policies and the payment method you use. Where required by law, statutory rights may apply in addition to these Terms.

Price and plan changes. We may change subscription prices or plans with reasonable notice where required by law or platform rules. Continued use after a price change may constitute acceptance; if you do not agree, you may cancel before the next renewal.

Trials and promotions. If we offer a free trial or promotional access, its duration and terms will be stated at signup. Unless you cancel before the trial ends, you may be charged the applicable subscription price when the trial converts to a paid subscription.

3. Use License

Permission is granted to temporarily download one copy of GymTok for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained in GymTok
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

4. User Accounts

To access certain features of GymTok, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Health and Safety Disclaimer

IMPORTANT: GymTok is a fitness tracking application and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or before starting any exercise program.

You acknowledge that:

• Physical exercise can be strenuous and may result in injury
• You should consult with a healthcare professional before beginning any exercise program
• You assume all risks associated with your use of GymTok and participation in any exercise program
• GymTok, LLC is not responsible for any injuries or health problems that may result from your use of the app

6. User Content

You retain ownership of any content you create, upload, or share through GymTok ("User Content"). By submitting User Content, you grant GymTok, LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your User Content solely for the purpose of operating and providing the service.

You agree not to submit User Content that:

• Violates any law or regulation
• Infringes on the rights of others
• Contains harmful, offensive, or inappropriate material
• Contains false or misleading information

7. Prohibited Uses

You may not use GymTok:

• In any way that violates any applicable law or regulation
• To transmit any malicious code, viruses, or harmful data
• To attempt to gain unauthorized access to any part of the service
• To interfere with or disrupt the service or servers
• To collect or harvest information about other users
• For any commercial purpose without our express written consent

8. Intellectual Property

The service and its original content, features, and functionality are owned by GymTok, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Service Availability

We reserve the right to modify, suspend, or discontinue any part of GymTok at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

10. Limitation of Liability

In no event shall GymTok, LLC, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

11. Indemnification

You agree to defend, indemnify, and hold harmless GymTok, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of GymTok or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the service will cease immediately.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GymTok, LLC is incorporated, without regard to its conflict of law provisions.
